Terms of Service: Do You Really Need One?
Terms of Service (ToS) sets the rules. "Don't hack us. We aren't liable if you lose money. We own the IP." Without it, you are naked in court.
What is Limitation of Liability?
Limitation of Liability is The most important clause. It says "If our app bugs out and you lose $1M, the most you can sue us for is $100 (or what you paid us)."
The 3 Core Benefits
Ban Hammer
ToS gives you the legal right to ban users for "Abuse." Without it, they could claim you breached contract.
IP Protection
It states that "We own the code, you own your data." It prevents users from claiming they own your platform innovations.
Dispute Resolution
You can force users to use "Arbitration" instead of suing you in huge class-action lawsuits. This saves legal fees.
Generating the ToS
Don't write it yourself
You are not a lawyer. Use a template (Y Combinator has free ones) or a service (Termly).
Define "User Content"
If users upload images, state clearly that YOU don't own them, but you have a license to display them.
SaaS SLA
For B2B, define the Service Level Agreement. "We aim for 99% uptime, but promise nothing." Be vague unless paid.
Governing Law
Pick your home state (e.g. Delaware). You don't want to fly to France to fight a lawsuit.
Display Accurately
Put "Terms" and "Privacy" links in your footer. It is legally required in many jurisdictions.
Copy-Paste vs. Generated Template
| Feature | Copy-Paste | Generated Template |
|---|---|---|
| Relevance | Wrong Company Name | Customized |
| Protection | Dubious | Standard |
| Cost | $0 | $50 |
Frequently Asked Questions
Can I copy a competitor?
It is copyright infringement, but... everyone does it. Just find/replace carefully. Better to use a template.
Do users have to sign it?
Clickwrap ("By signing up you agree") is usually enough. For Enterprise, they will redline (edit) it.
What about AI content?
Add a clause saying "AI output may be inaccurate. Use at own risk." Protect yourself from hallucinations.
What makes a launch channel high intent?
High-intent channels have users actively searching for solutions, not just browsing a feed.
How many channels should I launch on?
Start with 3-5 strong channels, measure conversions, then expand to 10-12 over time.
How do I avoid launch fatigue?
Stagger your launches and reuse assets so each channel gets a focused push.
What should I measure after launch?
Track qualified signups, backlinks, and demo requests, not just raw traffic.
How does Mesh of Growth fit with other platforms?
